Terms of service

1. Agreement to these Terms. BaseCamper LLC ("BaseCamper," "we," "us," or "our") operates the website at basecamper.com and the related features, tools, listings, content, and services we make available now or in the future (collectively, the "Services"). By accessing or using the Services, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services.

2. What BaseCamper is. BaseCamper is an overlanding-focused marketplace and discovery platform for buying, selling, and renting overland vehicles, trailers, truck campers, and related gear. For most listings, BaseCamper is a venue that connects buyers, sellers, renters, and rental hosts — we are not the buyer, seller, or rental provider, and we are not a party to the resulting transaction. The exception is items sold directly through our integrated checkout (see Section 6), where standard purchase terms apply. We do not own, inspect, or take possession of most items listed, and we make no warranty about any listing, item, host, seller, or third-party service.

3. Eligibility and accounts. You must be at least 18 years old and able to form a binding contract to use the Services. If you create an account, you are responsible for the accuracy of your information and for all activity under your account. Keep your credentials secure and notify us of any unauthorized use.

4. Listings and content. Listings on the Services come from several sources, including (a) items sold directly through BaseCamper's checkout, (b) items aggregated or referred from third-party sources, and (c) items submitted by independent sellers and hosts. We may add, edit, normalize, categorize, remove, or decline any listing at our discretion. We do not guarantee that any listing is accurate, current, available, lawfully offered, or that the seller or host is who they claim to be. You are responsible for any content you submit and grant us a non-exclusive, royalty-free license to host, display, adapt, and promote it in connection with the Services.

5. Buying and contacting sellers. Different listings offer different ways to transact or make contact — for example, adding an item to cart and checking out, viewing an original third-party listing, or expressing interest so that we can connect you with a seller. Where BaseCamper helps connect a buyer and a seller, we may share the contact details you provide (such as your name and phone number) with the relevant seller, host, or third party for the purpose of facilitating that connection. Except for items purchased through our integrated checkout, any sale, payment, inspection, title transfer, and delivery is solely between you and the seller. We are not responsible for, and do not guarantee, the condition, legality, safety, or transfer of any item.

6. Purchases through integrated checkout. Certain items can be purchased directly through BaseCamper's checkout, processed by Shopify and our payment providers. For those items, your order is subject to our posted pricing, availability, and any return or shipping terms shown at checkout or in our store policies. We may cancel or refuse any order (for example, for suspected fraud, pricing errors, or unavailability).

7. Rentals. BaseCamper provides discovery, listing, and referral tools for overland rentals. The actual booking, payment, insurance, deposits, cancellation, and rental agreement are handled by the rental host or by a third-party booking platform — not by BaseCamper. When you book a rental, you transact with that host or platform and are bound by their terms and policies. BaseCamper is not the rental provider, is not a party to the rental agreement, and is not responsible for the vehicle, equipment, host conduct, or the rental experience.

8. Third-party links, platforms, and affiliate relationships. The Services contain links to third-party websites, listings, and booking platforms that we do not control. Some links are affiliate or referral links, meaning BaseCamper may earn a commission or referral fee if you take an action (such as booking a rental) after following them, at no additional cost to you. Your use of any third-party site or service is governed by that third party's terms and privacy practices, not ours.

9. Fees. Browsing the Services is free for buyers and renters. We may charge fees for certain seller, host, or premium features; any such fees and their terms will be disclosed before you incur them.

10. Acceptable use. You agree not to misuse the Services, including by: posting false, misleading, infringing, or unlawful content; listing items you may not legally sell; scraping or harvesting data except as we permit; interfering with the Services' operation or security; harassing other users; or using the Services to facilitate fraud. We may suspend or terminate access for any violation.

11. Intellectual property. The Services, including our branding, design, text, and compiled content, are owned by BaseCamper or our licensors and protected by law. We grant you a limited, revocable, non-exclusive license to use the Services for their intended purpose. You may not copy, resell, or create derivative works from the Services without permission.

12. Disclaimers. THE SERVICES AND ALL LISTINGS, ITEMS, AND THIRD-PARTY SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or that any listing, seller, host, or item meets your expectations.

13. Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, BASECAMPER AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM A TRANSACTION, ITEM, RENTAL, SELLER, HOST, OR THIRD-PARTY SERVICE FACILITATED THROUGH THE SERVICES. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid BaseCamper in the 12 months before the claim or USD $100.

14. Indemnification. You agree to indemnify and hold harmless BaseCamper and its operators from any claim or demand arising out of your use of the Services, your content, your transactions with other users, or your violation of these Terms or applicable law.

15. Privacy. Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

16. Changes to the Services and Terms. We may modify or discontinue any part of the Services, and we may update these Terms from time to time. Changes are effective when posted, and your continued use of the Services means you accept the updated Terms. Material changes will be reflected in the "Last updated" date above.

17. Governing law. These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Utah, and you consent to their jurisdiction.
